How can a system of criminal punishment be justified? In particular can it be justified if the moral demand that we respect each other as autonomous moral agents is taken seriously? Traditional attempts to justify punishment as a deterrent or as retribution fail, but Duff suggests that punishment can be understood as a communicative attempt to bring a wrong-doer to repent her crime. This account is supported by discussions of moral blame, of penance, of the nature of the law's demands, (...) and of the proper meaning and purpose of the criminal process of trial and verdict: it deals both with the ideals that should inform a system of criminal law and the extent to which those ideals are actualised in existing institutions and practices. The conclusion is pessimistic: punishment cannot be justified within our legal system; and this gap between the ideal and the actual presents us with serious moral dilemmas. (shrink)

Aesthetics in philosophy of mathematics is too narrowly construed. Beauty is not the only feature in mathematics that is arguably aesthetic. While not the highest aesthetic value, being interesting is a sine qua non for publishability. Of the many ways to be interesting, being explanatory has recently been discussed. The motivational power of what is interesting is important for both directing research and stimulating education. A combination of social forces has thrown marriage into question in westernised societies at the end of the millennium. This uncertainty creates space for new ways of thinking about marriage. In this context, we examine the idea of marriage as friendship. We trace its genealogy in the work of Mary Wollstonecraft, John Stuart Mill and Harriet Taylor and then subject it to critical scrutiny using some of Michel de Montaigne’s ideas. We ask how applicable the ideal of higher friendship is (...) to marriage and what might be gained and lost by a synthesis of marriage and friendship. Grounding the discussion in historical sources is valuable because the topic is so little explored in the contemporary philosophical literature. This approach also allows any enduring value in these historical texts to be elicited. (shrink)

This book is a new edition of a short but fascinating treatise by Galen on causal theory. This text survives only in a Latin translation of the fourteenth century, and it is this which appears here. The volume also contains the first translation of the treatise into any modern language, and the first philosophical commentary thereon. The commentary ranges widely in Galen's voluminous œuvre, and compares his views with those of other ancient theorists. This collection of essays by leading international philosophers considers central themes in the ethics of Danish philosopher Knud Ejler Løgstrup (1905–1981). Løgstrup was a Lutheran theologian much influenced by phenomenology and by strong currents in Danish culture, to which he himself made important contributions. The essays in What Is Ethically Demanded? K. E. Løgstrup’s Philosophy of Moral Life are divided into four sections. The first section deals predominantly with Løgstrup’s relation to Kant and, through Kant, the system of morality in (...) general. The second section focuses on how Løgstrup stands in connection with Kierkegaard, Heidegger, and Levinas. The third section considers issues in the development of Løgstrup’s ethics and how it relates to other aspects of his thought. The final section covers certain central themes in Løgstrup’s position, particularly his claims about trust and the unfulfillability of the ethical demand. The volume includes a previously untranslated early essay by Løgstrup, “The Anthropology of Kant’s Ethics,” which defines some of his basic ethical ideas in opposition to Kant’s. By probing political and philosophical trends, it provides an alternative analysis for the rise of contemporary China.

The environmental movement continues to be a dynamic force for protection of the environment despite new organizations emerging from the “birthing” process of the formation of new groups via factions and schisms. I focus on two aspects of the evolution of the environmental movement: how do new organizations emerge from existing environmental groups via benevolent or divisive mechanisms; and, which organizations produce new organizations? I develop a family tree of the American environmental movement from 1955 – 2005 and identify the (...) mechanisms that result in the formation of new organizations from a sample of 48 environmental organizations. I use social network analysis to identify which environmental organizations were most likely to produce new groups and set the stage for future inquiries into how new environmental organizations reestablish and maintain connections with their progenitors.
